PLEASE READ THIS REFUNDS AND RETURNS POLICY CAREFULLY BEFORE MAKING A PURCHASE ON CAHU.NET (“THE PLATFORM”). BY PURCHASING PRODUCTS FROM THE PLATFORM, YOU (“THE BUYER”) AGREE TO BE BOUND BY THE TERMS OF THIS POLICY.
1. SCOPE
This Refunds and Returns Policy applies to all purchases of digital goods and services (“Products”) made through the Platform. Due to the nature of digital Products, specific conditions apply to refunds and returns as outlined below.
2. REFUNDS
2.1 Eligibility for Refunds
Refunds are granted under the following circumstances:
a) Non-Delivery of Products: If the Vendor fails to deliver or provide access to the purchased Product within the stipulated timeframe, not exceeding thirty (30) days unless otherwise stated by the Vendor.
b) Product Not as Described: If the Product delivered materially differs from its description provided on the Platform at the time of purchase.
c) Distribution Limitations: If the Product cannot be delivered due to distribution limitations such as licensing restrictions or geographical restrictions imposed after the purchase.
2.2 Buyer’s Responsibility
a) Legal Compliance: The Buyer is solely responsible for ensuring that the purchase, download, and use of the Products are lawful in the jurisdiction where the Buyer resides and intends to use them. Refunds will not be granted if the Product is illegal in the Buyer’s location.
2.3 Ineligibility for Refunds
a) Change of Mind: Refunds are not granted if the Buyer changes their mind after the purchase.
b) Compatibility Issues: Refunds are not granted due to incompatibility of the Product with the Buyer’s hardware, software, or other equipment.
c) Unauthorized Purchases: Refunds are not granted for purchases made by unauthorized third parties using the Buyer’s account.
3. RETURNS
3.1 No Returns Policy
a) Digital Nature of Products: Given that the Platform exclusively sells digital goods and services, returns are not possible once the Product has been delivered or accessed by the Buyer.
3.2 Finality of Transactions
a) Order Cancellation: Once an order is submitted and payment is processed, the transaction is final. Orders cannot be canceled or modified after submission.
4. REFUND PROCESS
4.1 Requesting a Refund
a) Timeframe: Refund requests must be submitted within seven (7) days from the date of delivery or the end of the stipulated delivery timeframe if the Product was not delivered.
b) Method of Request: Refund requests should be submitted in writing via email to Customer Service or through the Platform’s support portal, including the order number and a detailed explanation of the issue.
4.2 Assessment of Refund Requests
a) Evaluation: The Marketplace will evaluate the refund request in collaboration with the Vendor to determine eligibility under this Policy.
b) Decision Notification: The Buyer will be notified of the decision regarding the refund request within ten (10) business days of receipt.
4.3 Refund Methods
a) Original Payment Source: Refunds will be issued to the original payment method used for the purchase.
b) Store Credit: If a refund to the original payment source is not possible, or at the Buyer’s request, the refund may be provided as store credit for use on the Platform.
5. EXCEPTIONS AND SPECIAL CONDITIONS
5.1 Vendor-Specific Policies
a) Additional Terms: Some Vendors may have specific refund policies that provide additional rights or remedies. Such policies will be detailed in the Product listing and are supplemental to this Policy.
5.2 Statutory Rights
a) Consumer Protection Laws: Nothing in this Policy is intended to limit or exclude any legal rights you may have under the laws of the Hong Kong Special Administrative Region.
6. LIMITATION OF LIABILITY
6.1 Marketplace Liability
a) Limited Responsibility: The Marketplace’s responsibility is limited to facilitating the refund process between the Buyer and the Vendor.
6.2 Vendor Liability
a) Vendor Obligations: The Vendor is responsible for delivering the Product as described and is liable for any refunds under the conditions stated in this Policy.
7. FRAUD AND ABUSE
7.1 Investigation Rights
a) Suspicious Activity: The Marketplace reserves the right to investigate any refund requests for potential fraud or abuse.
7.2 Denial of Refunds
a) Abusive Behavior: Refunds may be denied if the Marketplace determines that the Buyer is abusing the refund process.
7.3 Account Suspension
a) Policy Violation: The Marketplace may suspend or terminate the Buyer’s account for violations of this Policy or any fraudulent activities.

9. CHANGES TO THIS POLICY
a) Amendments: The Marketplace reserves the right to modify this Refunds and Returns Policy at any time. Any changes will be effective immediately upon posting on the Platform.

10. GOVERNING LAW AND JURISDICTION
10.1 Applicable Law
a) Legal Framework: This Policy is governed by the laws of the Hong Kong Special Administrative Region.
10.2 Dispute Resolution
a) Arbitration: Any disputes arising from or related to this Policy shall be resolved through arbitration in accordance with the procedures outlined in the Platform’s Terms and Conditions.
11. LANGUAGE
a) Prevailing Language: In the event of any inconsistency between the English version of this Policy and any translation, the English version shall prevail.
12. ACKNOWLEDGEMENT
By making a purchase on the Platform, you acknowledge that you have read, understood, and agree to be bound by this Refunds and Returns Policy.
